2. General Terms and Conditions of Use of Website and of Services Offered

In using the website, users are deemed to accept the general terms and conditions of use described below, unconditionally and in full. These terms and conditions of use may be amended or added to at any time, and users of the website are therefore invited to consult them at regular intervals.

This website is normally accessible to users at all times. However, may decide to interrupt access for technical maintenance purposes, but in this case it will endeavour to notify users in advance of intervention dates and times. We update the website at regular intervals. Likewise, the legal information appearing on the site may be amended at any time. However, it is still binding on the user, who is invited to consult it as often as possible, in order to take due note of it. 3. Description of services provided

The website is intended to provide information on all of the company’s activities: the Samse Group’s activities, finances, business lines and product ranges.

This website is not a commercial website, and the information disseminated on it shall not be deemed to constitute a marketing offering and/or construed as prospecting for business, or deemed comparable to any type of warranty, regardless of purpose, and in particular a warranty covering a product’s merchantability, its fitness to meet a specific need or its compliance with the legal and/or regulatory provisions applicable to it.

Samse will endeavour to ensure that any information provided on the website is as accurate as possible. However, it cannot be liable for any omissions, inaccuracies or shortcomings in the updates applied, whether caused by its own doing or that of any third party partners providing such information to it.

All of the information appearing on the website is provided in an indicative capacity, and is liable to change. Moreover, the information appearing on the website is not exhaustive. It is provided subject to any changes made since it was first published on line. This information is not contractual in nature.

4. Intellectual property and infringements

Samse owns the intellectual property rights or holds the user rights over all elements accessible on the website, including texts, images, graphics, the logo, icons, sounds and software programs.

Any reproduction, public display or performance, modification, publication or adaptation of any elements of the website, in whole or in part, undertaken by whatever means or process, is prohibited, unless Samse has first granted its permission in writing.

Any unauthorised exploitation of the site or of any of its constituent elements shall be deemed to constitute infringement, and will result in legal action being taken, under Articles L.335-2 et seq. of the Intellectual Property Code.

5. Limitations of liability

Samse shall not be liable for any direct or indirect loss or damage caused to users’ equipment when accessing the Samse website, and caused either by using equipment that does not comply with the specifications indicated in point 4, or by a bug or incompatibility that becomes apparent.

Interactive areas are provided for the benefit of users (questions can be asked in the contact area or in the project submission form). Samse reserves the right to delete, without prior warning, any content left in this area that contravenes the laws applicable in France, and especially the provisions of the data protection laws. If applicable, Samse also reserves the right to hold users liable under civil and/or criminal law, notably if they post any message that is racist, offensive, slanderous or pornographic in nature, via any medium (text, photograph, etc.).

6. Management of personal data

In France, personal data is protected in particular by Law no. 78-17 of 6 January 1978, Law no. 2004-801 of 6 August 2004, Article L. 226-13 of the Criminal Code and the European Directive of 24 October 1995.

The following data may be gathered when visitors use the website the URL of the links via which the user has accessed the website, the user’s Internet access provider, and the user’s Internet Protocol (IP) address.

In all circumstances, Samse gathers users’ personal information solely in connection with the requirements of certain services offered by the website Users provide such information based on full knowledge of the facts, especially where they enter this data themselves. In this case, users of the website are informed whether or not they are under any obligation to provide such information.

Under Articles 38 et seq. of Law 78-17 of 6 January 1978 governing data protection, all users are entitled to access, rectify and object to the information held on them, by submitting a signed request in writing, accompanied by a copy of their ID document, bearing the holder’s signature and stating the address to which the reply should be sent, to the following address:

No personal information on users of the website will be published without their knowledge, or exchanged, transferred, assigned or sold to third parties, on any medium whatsoever. The only circumstances in which the said information might be transferred would be a takeover of Samse and the rights it holds, and in this case any purchaser would be under the same obligation to protect and amend the data held on users of the website

The website contains a number of hypertext links to other sites, inserted with Samse’s permission. Samse is however unable to check the content of the sites visited in this way, and therefore cannot assume any liability in this regard.
